Fair play wins.
Even online.

We support companies in complying with the rules of competition and unfair-competition law, in particular in defending against unfair commercial practices and in enforcing claims against competition-law violations — and we review advertising campaigns and claims for legal compliance. In e-commerce, we provide companies with comprehensive advice both before the launch of an online shop and during ongoing operation, draft individual terms and conditions, and prepare legally sound privacy policies in line with the applicable statutes (such as the GDPR (DSGVO), DDG (German Digital Services Act), and TDDDG (German Telecommunications Digital Services Data Protection Act)).

What we do.

01

Fair competition

We support compliance with competition statutes, protect against unfair commercial practices, and enforce claims against competition-law violations — from the cease-and-desist warning (Abmahnung) through the einstweilige Verfügung (preliminary injunction) to litigation (§§ 3, 8 UWG (German Act Against Unfair Competition)).

02

Advertising & marketing

We review advertising measures for legal compliance — from misleading and comparative advertising through price indications to the labeling of advertising — and develop strategies with you for a fair presence that keeps cease-and-desist warnings at bay.

03

Online shops & online retail

Whether before launch or during ongoing operation: We provide comprehensive counsel on the legal requirements of online retail — information obligations, the right of withdrawal, the "button solution" (§ 312j BGB (German Civil Code)), and price indications (PAngV (German Price Indication Ordinance)) — aligned with your goals.

04

Terms and conditions & privacy policy

We draft and review individual Allgemeine Geschäftsbedingungen (general terms and conditions) and prepare a legally sound privacy policy under the GDPR (DSGVO). This also includes legally compliant cookie management under the TDDDG — from the lawful handling of fingerprinting, cookies and local storage to the avoidance of dark patterns. We handle more complex data protection questions with our team for Data protection & data law.

Fair competition

Fair competition is not an end in itself — it is what allows the better offer to win, not the most brazen one. We make sure the rules apply to everyone.

Frequent questions.

[ FAQ ]
Question 01
Warning letters

I have received a competition-law cease-and-desist warning — what should I do?

Take the deadlines seriously, but do not sign hastily. We examine whether the cease-and-desist warning is justified and not an abuse of rights, and respond accordingly — from a modified cease-and-desist declaration (Unterlassungserklärung) to a defense against unfounded claims.

Question 02
Advertising

What do I need to watch out for in advertising?

Advertising must not mislead (§ 5 UWG), must be recognizable as advertising, and must provide complete and transparent price information. Comparative advertising is permissible only under narrow conditions. We review your campaigns in advance so that cease-and-desist warnings are less likely to arise in the first place.

Question 03
Online shops

What does a legally sound online shop need?

Among other things, a complete legal notice (Impressum), the statutory information obligations, a correct withdrawal notice, the "button solution" at checkout (§ 312j BGB), correct price indications (PAngV), plus suitable terms and conditions and a privacy policy. We review the shop before launch and during ongoing operation.

Question 04
Terms and conditions

Are online template terms and conditions enough?

Rarely. Templates often do not fit the specific business model, contain invalid clauses, and carry the risk of cease-and-desist warnings. We draft individual terms and conditions that fit your products, processes, and audiences.

Question 05
Data protection

Do I need my own privacy policy?

Yes. A privacy policy under the DSGVO is mandatory and must match the tools, trackers, and service providers actually in use. We prepare a legally sound policy and handle more complex data protection questions with our team for Data protection & data law.
